The impact of Brexiton international IP rights.

After the UK’s official leave from EU on January 31st, 2020, a transitional period begun for continued protection in the UK for community trademarks and designs. Such transitional period willend on December 31st, 2020.Therefore, as from January 1st, 2021, the designation of EU in international registrations will no longer provide protection in the UK.

Notwithstanding the above, all EU registrations granted before December 31st, 2020 will automatically be cloned to UK’s national registrations. For applications pending on December 31st, 2020, applicants will have an additional 9 month-period to apply for the same protection in UK.

Considering that the European Patent Office (EPO) is not an agency of EU, the patent system will not be affected by Brexit.
