Based on the excellent results already achieved by the Backlog Combat Plan and the Patent Prosecution Highway (PPH) priority examination, the Brazilian Patent and Trademark Office (‘BPTO’) is evaluating the possibility of anticipating the beginning of the PPH’s second phase, from January 1st, 2022 to January 1st, 2021, as well as the following proposals:
– increasing the number of participation requests from 400 to 600 per annual cycle;
– increasing the number of requests for patent applications classified in the same International Patent Classification (‘IPC’) from 100 to 150 per annual cycle;
– increasing the number of requests for patent applications by the same applicant or owner, from 1 request per month to 1 request per week; and
– accepting requests for applications from any partner Office of First Filing.
The PPH aims to help applicants in obtaining patent rights with greater legal certainty and efficiency in several countries, in addition to optimizing the examination of the main patent offices worldwide.
