THE BPTO’S PLAN TO TACKLE BACKLOG REACHES PROMISING RESULTS IN REDUCING THE TIME FOR A FINAL DECISION ON PATENT APPLICATIONS

The plan to tackle the BPTO’s patent backlog (in force since August 1st, 2019) has shown excellent results. According to Dr. Liane Lage (BPTO’s patent director), there has been a reduction in the time to reach a final decision in all technical divisions between 2018 and 2019. For example, Biodrugs and Pharma I divisions have presented the best results – the first reduced said time from 13.13 to 10.74 years, while the second showed a reduction from 12.74 to 11.02 years. The average time to reach a final decision among all the technical divisions fell from 10 to 9.3 years.

The BPTO aims to reduce the patent backlog by 80% by 2021, and decrease the average time for a final decision to two years counted from the date of examination request. According to the BPTO’s official data (updated on January 7, 2020), the backlog was already reduced by 12.77% since the launch of the plan.
