On August 26, 2025, the Brazilian PTO (INPI) published its first decisions on requests for expedited examination of trademark applications. These decisions concerned priority requests filed by elderly applicants. A total of 21 requests were granted expedited examination, and in 16 of those cases, the INPI issued immediate decisions on the merits. The Office has not disclosed whether additional requests were filed during the same period. Notably, some of the applications had been filed as recently as April and received substantive decisions in less than six months.
Pursuant to INPI/PR Ordinances Nos. 27, 28, and 29 of 2025, a request for expedited examination may be filed at any stage of a trademark application’s prosecution. Nevertheless, prioritization will only take effect once the statutory deadlines for third-party oppositions and for the applicant’s reply to an opposition, if any, have expired.
Starting September 2, the INPI will issue weekly updates identifying petitions eligible for prioritization that have not yet been implemented due to the pendency of the opposition or reply periods.
