The BPTO published for public consultation the draft Resolution about divisions of trademark registrations and applications. Interested parties may send suggestions and comments until June 20, 2019.

The Brazilian Patent and Trademark Office (“BPTO”) is preparing to implement proceedings for (a) trademark registration in a multiclass system; (b) joint ownership of trademark registrations; (c) divisions of trademark registrations and applications; and (d) trademark registrations under the Madrid Protocol. Four resolutions were published dealing with trademark registrations under these conditions.

The BPTO published the public consultation on the draft Resolution about divisions of trademark registrations and applications. According to the proposed Resolution, the division shall be allowed in case of (a) suspension of examination that does not encompass all classes for which the application or registration has been filed, as well as (b) assignment which does not include the mark in all classes.

Interested parties may send suggestions and comments until June 20, 2019. After such deadline, the BPTO will present the proposals received, the responses to the contributions and the final text of the Resolution.
